利用規約

第 1 条（適用）

本規約は、開発者（以下「開発者」）が提供する iOS アプリ「RakuSakuAlbumSort」（以下「本アプリ」）の利用条件を定めるものです。ユーザは本アプリを利用することにより、本規約、プライバシーポリシーおよび特定商取引法に基づく表記の内容に同意したものとみなします。

第 2 条（利用環境）

ユーザは自己の責任と費用で、本アプリの利用に必要な端末、OS、通信環境、Apple ID その他の利用環境を準備するものとします。

第 3 条（本アプリの機能）

本アプリは、端末上の写真・動画を整理するための閲覧、選択、保留、削除補助等の機能を提供します。本アプリによる「削除」は iOS の「最近削除した項目」への移動であり、完全削除、復元、バックアップを保証するものではありません。

第 4 条（写真・動画の取り扱い）

  1. ユーザは、写真・動画の選択、削除、保留、復元その他一切の操作を自己の責任で行うものとします。
  2. 開発者は、ユーザの操作、端末や OS の状態、同期設定、外部サービスの挙動その他の理由により写真・動画またはデータが消失、破損、変更、閲覧不能となった場合であっても、一切の責任を負いません。
  3. ユーザは、重要な写真・動画について、必要に応じて事前にバックアップを行うものとします。

第 5 条（広告）

本アプリは Google AdMob による広告を表示する場合があります。広告の内容、遷移先、第三者の商品・サービスについては、Google または広告主の責任に属し、開発者は一切保証せず、これらに関して一切の責任を負いません。

第 6 条（サブスクリプション）

  1. 開発者は本アプリにおいて、週額、月額、年額の自動更新サブスクリプション（以下「本サブスク」）を提供する場合があります。
  2. 本サブスクは Apple StoreKit / App Store を通じて提供され、決済、更新、解約、返金その他の取扱いは Apple の規約およびポリシーに従います。
  3. 1 年プランは、初回購入時に 7 日間の無料お試し期間を提供する場合があります。無料期間中に解約しない場合、自動的に有料期間へ移行します。
  4. 解約は iOS の「設定 → Apple ID → サブスクリプション」から行えます。次回更新日の 24 時間前までに解約しない場合、自動更新されることがあります。
  5. 価格、期間、無料お試し、提供条件は App Store 上の表示を優先します。

第 7 条（ログの取得）

開発者は、本アプリの品質向上、不具合調査、利用状況の把握および機能改善のため、個人情報を含まないログを取得する場合があります。ログの内容および取扱いは、プライバシーポリシーに定めるものとします。

第 8 条（禁止事項）

ユーザは以下の行為を行ってはなりません。

第 9 条（知的財産権）

本アプリ、関連ドキュメント、画像、文章、プログラムその他本アプリに関する知的財産権は、開発者または正当な権利者に帰属します。

第 10 条（保証の否認）

開発者は、本アプリについて、正確性、完全性、有用性、安全性、特定目的への適合性、継続的な提供、不具合や障害が発生しないこと、データが保持されること、第三者サービスが正常に動作することを含め、明示または黙示を問わず一切保証しません。

第 11 条（免責）

  1. 開発者は、本アプリの利用または利用不能、本アプリに関する設定、操作、削除、課金、広告表示、第三者サービス、端末や OS の不具合、通信障害、データの消失または破損、その他本アプリに関連してユーザまたは第三者に生じた損害について、法令上許容される最大限の範囲で一切の責任を負いません。
  2. 前項にかかわらず、強行法規により開発者の責任を完全に免除できない場合であっても、開発者の責任は、開発者に故意または重過失がある場合を除き、ユーザが直近 1 か月に本アプリへ実際に支払った金額を上限とします。

第 12 条（サービスの変更・停止・終了）

開発者は、事前の通知なく、本アプリの全部または一部を変更、追加、停止、終了することができます。これによりユーザに損害が生じた場合でも、開発者は一切の責任を負いません。

第 13 条（規約の変更）

開発者は、必要に応じて本規約を改定できます。改定後の規約は、本アプリ内、App Store 上または開発者が適切と判断する方法で表示された時点から効力を生じます。ユーザが改定後に本アプリを利用した場合、改定後の規約に同意したものとみなします。

第 14 条（準拠法・管轄）

本規約は日本法を準拠法とします。本アプリに関して紛争が生じた場合、開発者の住所地を管轄する地方裁判所または簡易裁判所を第一審の専属的合意管轄裁判所とします。

Article 1 (Application)

These Terms of Use define the conditions for using the iOS app "RakuSakuAlbumSort" (the "App") provided by the developer (the "Developer"). By using the App, users are deemed to have agreed to these Terms of Use, the Privacy Policy, and the notation based on Japan's Act on Specified Commercial Transactions.

Article 2 (Usage Environment)

Users are responsible, at their own cost, for preparing the device, OS, communication environment, Apple ID, and any other environment necessary to use the App.

Article 3 (App Features)

The App provides features such as viewing, selecting, holding, and assisting deletion of photos and videos on the device. A "delete" operation by the App means moving items to the iOS "Recently Deleted" album and does not guarantee permanent deletion, restoration, or backup.

Article 4 (Handling of Photos and Videos)

  1. Users are responsible for all operations involving photos and videos, including selection, deletion, holding, and restoration.
  2. The Developer assumes no responsibility for loss, corruption, alteration, or inability to view photos, videos, or data caused by user operations, device or OS state, sync settings, external services, or any other reason.
  3. Users should back up important photos and videos in advance as necessary.

Article 5 (Advertisements)

The App may display advertisements through Google AdMob. The content of advertisements, linked destinations, and third-party products or services are the responsibility of Google or the advertiser. The Developer makes no warranty and assumes no responsibility for them.

Article 6 (Subscriptions)

  1. The Developer may provide automatically renewing weekly, monthly, or yearly subscriptions in the App (the "Subscription").
  2. The Subscription is provided through Apple StoreKit / App Store. Payment, renewal, cancellation, refunds, and other handling follow Apple's terms and policies.
  3. The yearly plan may include a 7-day free trial for the first purchase. If the user does not cancel during the free trial, the plan automatically moves to a paid period.
  4. Users can cancel from iOS "Settings > Apple ID > Subscriptions." If the user does not cancel at least 24 hours before the next renewal date, the Subscription may renew automatically.
  5. Prices, periods, free trials, and offer conditions shown on the App Store take precedence.

Article 7 (Log Collection)

The Developer may collect logs that do not include personal information for quality improvement, issue investigation, usage analysis, and feature improvement. The contents and handling of logs are defined in the Privacy Policy.

Article 8 (Prohibited Acts)

Users must not perform the following acts:

Article 9 (Intellectual Property Rights)

Intellectual property rights related to the App, related documents, images, text, programs, and other App-related materials belong to the Developer or legitimate rights holders.

Article 10 (Disclaimer of Warranty)

The Developer makes no express or implied warranty regarding the App, including accuracy, completeness, usefulness, safety, fitness for a particular purpose, continuous provision, absence of defects or failures, data retention, or proper operation of third-party services.

Article 11 (Limitation of Liability)

  1. To the maximum extent permitted by law, the Developer assumes no responsibility for damages incurred by users or third parties in connection with use or inability to use the App, App settings, operations, deletion, billing, advertisements, third-party services, device or OS issues, communication failures, data loss or corruption, or any other App-related matter.
  2. If mandatory law does not permit complete exclusion of the Developer's liability, the Developer's liability is limited to the amount actually paid by the user to the App during the most recent one-month period, except in cases of intentional misconduct or gross negligence by the Developer.

Article 12 (Changes, Suspension, and Termination)

The Developer may change, add, suspend, or terminate all or part of the App without prior notice. The Developer assumes no responsibility for damages incurred by users as a result.

Article 13 (Changes to These Terms)

The Developer may revise these Terms of Use as necessary. The revised terms become effective when displayed in the App, on the App Store, or by another method the Developer considers appropriate. If users use the App after the revision, they are deemed to have agreed to the revised terms.

Article 14 (Governing Law and Jurisdiction)

These Terms of Use are governed by the laws of Japan. If a dispute arises in connection with the App, the district court or summary court having jurisdiction over the Developer's address shall be the exclusive court of first instance.
